A line drawn due north from this point, however, would have been inconvenient both to the Americans, who had granted land between there and the Chiputneticook, and to the British and New Brunswickers, because it would place their military posts, which were further north at Presque Isle and Grand Falls, on the American side of the boundary. 24 Chipman shifted his support to the Chiputneticook and obtained the agreement of Robert Listen, the British minister to the United States, who arrived fortuitously in Providence.

On 24 August the Americans rejected the British terms. 'A Treaty concluded on such terms would be but an armistice,' they said. 'It is impossible in the natural course of events, that she should not at the first favourable opportunity recur to arms, for the recovery of her territory, of her rights, of her honour. '51 In these circumstances, Gallatin wrote to Secretary of State Monroe that it was clear that the British had extensive military plans for the northern states, the Chesapeake Bay area, and New Orleans.

As a result of these discussions, Rufus King, the American minister in London, was instructed to open negotiations on these several problems. Rufus King and Foreign Secretary Lord Hawkesbury signed a treaty on 12 May 1803, placing the coastal boundary on a line running from the mouth of the St Croix south and west of Deer Island and then north around Campobello Island and thence on into the Bay of Fundy (but making no mention of Grand Manan Island, which seems to have been originally inhabited by Americans).
